 Herringbone Terms and Conditions

On deposit, you agree to the following terms and conditions of sale. If you are unsure about any of these terms, please contact us to clarify them before placing your order. These terms are subject to change, each order may be subject to different terms.

These terms fall under English law and the jurisdiction of the English courts.

Legal

We are not liable for any indirect or consequential losses incurred as a result of us being unable to meet our obligations because of events outside of our control, or for any reasonably foreseeable losses at the time of deposit. You must follow all appliance instructions, including whether they can be placed inside cabinetry or not. This includes all cabinetry but especially toasters and microwaves in cabinetry. Do not use toasters inside of cabinetry or leave appliances plugged in inside larders.

Design

A Design does not include a technical survey, and therefore all measurements are for guidance purposes only. Our design, when presented or sent to you, is our interpretation of your requirements.

Guarantees

At Herringbone Kitchens we pride ourselves on building kitchens that are made to last. For this reason, we provide a lifetime guarantee to cover the structural integrity of our cabinetry (this includes any unnatural bowing, warping or cracking of the timber). This lifetime guarantee does not apply if your cabinetry has been handled carelessly, purposefully damaged or neglected by you or any third party. Our cabinetry should be cleaned just with warm water and a soft cloth.  Herringbone will not be liable for any damages that have occurred as a result of the above.

Movement, knots, graining and colour variations are all characteristics of solid wood and are not imperfections. Minor cracking may occur to the paintwork due to atmospheric changes and chipping due to use; which is repairable with some touch-up paint and is not covered in our guarantee.   Finally, we are not responsible for damage due to other contractors/tradespersons (e.g. plumbing or after work).

If Herringbone install open shelving, we only recommend storing glasses and light decorative items on your open shelving. Our spice racks have a weight limit of 10 kilos, our drawers can fit 60 kilos and our upper cabinets can hold 30 kilos.  Herringbone does not accept any responsibility for damages caused as a result of storing heavy items (including but not limited to plates, mugs, bowls, crockery).

Our worktops, handles, appliances and tiles come with their own manufacturer warranties unrelated to Herringbone. For example, Silestone worktops can be registered with Silestone for a 25-year warranty, the details of which you can find at silestone.co.uk/warranty and any natural stone worktops usually come with their own 10-year warranty. We do not guarantee appliances, sinks, handles or taps.  We recommend that you check with the manufacturer and register your products with them.  We do not recommend you place dryers or microwaves in cabinetry, if you decide you would like this in your design Herringbone will not take any responsibility for damages caused and would always recommend you keep the door open when using.

Handmade

Each cabinet is handmade, hand painted, and thus unique.  Changes in colour, texture and wood grains are all characteristics of this.  Each painted cabinet is hand painted using a natural rich water based eggshell paint and therefore, there may be a slight variation between cabinets. You are advised that brush strokes will be heavier in darker colours of paint, this cannot be remedied. Paint colours can sometimes change over time as they respond to sunlight exposure and moisture content in the air. Our unpainted oak doors are a natural product; that has a natural variation of wood grain and colour.

Payments

When you place an order, you agree to pay a non-refundable 10% deposit at the time of order. Following this we will prepare the drawings/plans and speak to additional trades and/or architect and project managers regarding the kitchen following this initial payment.

The second payment of 40% of total amount is due 8 weeks After the initial deposit or at your Design Sign-Off, whichever is sooner. No changes can be made to your design or product following your sign-off and at this point you will be asked to sign off your final design and quote. Please double check everything over at this point.

The third payment of 50% less £500 is due 8 weeks prior to your installation date. I

The final payment of £500 is due on completion of the kitchen installation. Should there be delays with outsourced products i.e. appliances or handles, for reasons out of our control of Herringbone, the final invoice will still be due following installation of the cabinetry. If you are delayed in moving in, Herringbone will wrap your kitchen the best we can, and final payment will be due.

If you request a new fit date at any point after your fit date is confirmed and booked in our schedule, we will reasonably accommodate this change, but payment will still be due at the initially scheduled and agreed payment dates. If you request to change your fit date within 6 weeks of your initial start date, additional charges may apply, see Fitting section below.

If your kitchen is sold on a supply-only basis, upon the receipt of a non-refundable 10% deposit, Herringbone agrees to give you the drawings/plans and speak to additional trades and/or architects and project managers about the kitchen. 40% is due at sign-off and the final 50% is due 8 weeks before delivery.

All goods provided to the customer remain property of Herringbone Kitchens until payment is made in full. Failure to complete payment may result in repossession of goods and legal action to recover outstanding payments and costs. Any payments overdue by 30 days from the date of issue will be charged interest on the unpaid amount at a rate of 3% per annum above HSBC bank base rate.

Order

All orders are subject to availability. If your order is unavailable, we will reasonably notify you. We will also provide suggestions of goods of similar quality and price.

If the delivery date of your kitchen is over a year past the date of order, we may change the cost of your kitchen to reflect our latest prices.

Deliveries

With respect to supply-only products, it is the client’s responsibility to check ceiling heights and doorway sizes, to make sure all items fit with regards to delivery. The client will be required to sign for and inspect the goods at the time of delivery. When accepting delivery of your kitchen, the client agrees to identify any damage or shortfalls. Any losses or damages must be clearly written on the delivery note at this time, as no claims for damage can be made after this. If your kitchen is supply only, please be aware that deliveries are to curb side only. Any assistance moving the delivery will need to be arranged.

Delivery dates quoted are not contractual, and although we will employ reasonable measure to ensure prompt delivery of goods. Herringbone is not liable for any delay in delivery. You agree that delayed delivery of goods does not entitle you to cancel the order, reject the goods or withhold payment.

Installation

We reserve the right to modify the provisional date provided if at pre-fit survey the room is not watertight, walls plaster boarded, plywood up where wall cabinets hang and flooring scheduled in. If the room does not meet our requirements, you may be offered alternative solutions to keep your install date however this may void some guarantees (e.g. cabinetry may move in a non-watertight room). Herringbone fitters are all fully insured. In the event that you order a kitchen for supply only, we will not accept responsibility for any issues or damages which occur during the installation of your kitchen, we strongly recommend checking your fitter has their own insurance.

Cancellation & Exchanges

Upon initial deposit, Herringbone agrees to fulfil the order of goods within your quote. All cabinetry is non-refundable.

Where you have ordered third party goods such as appliances, handles, sinks, taps etc, Herringbone will follow manufacturers’ guarantees and terms of replacement. This may affect our ability to respond to remedial works. In certain cases, any warranty issues must be addressed directly to the manufacturer. Sale on appliances is final and cannot be returned or exchanged to Herringbone unless faulty.

Fitting

Where the client has contracted Herringbone to fit the kitchen, the client will ensure that:

·          Easily accessible parking is provided for one van, for the duration of the fitting:

·          The site is clean, safe and watertight and Herringbone can conduct the fit unhindered by other trades or works;

·          Switched fused 240v power is provided.

·          The heating is on, Aga (where relevant) is installed and all appliances are on site and ducting ran.

·          The room is lit and we are the only trades in the room at any one time.

·          Herringbone assumes that all walls cabinetry goes against are solid and structurally sound to hold cabinetry weight, the wall is solid and has 18mm plyboard behind plasterboard.

In the event that, in the opinion of the fitters, the site is in a state that would not allow the fitting to proceed OR would compromise the integrity of the kitchen units and/or worktops, or other contractors’ works have not been completed to allow the fit to proceed, then the company reserves the right to withdraw from the site until the kitchen is ready to fit as per our terms of fitting. If the fitters need to extend electrical or plumbing works, then appropriate labour and material charges will apply.

Any delays within 6 weeks of your kitchen delivery date are subject to storage fees of £100 per week which will be added to your third invoice. If your project is delayed within 6 weeks of your kitchen delivery date, you may be charged £200 plus VAT per fitter, per day that the site is not accessible for the scheduled duration of the fit, up to a maximum of 5 days. If we are required to reschedule the fit because of any of the aforesaid items, then we will make every effort to revisit as quickly as possible but cannot be held liable for any delays.

Due to current building regulation legislation we cannot connect any appliance, sink or tap. The customer should make your arrangements for this (unless we are explicitly contracted to do this).

Exclusion

For the avoidance of doubt, the contract does not include:

·          Making good as a result of removal or repairs caused by other contractors.

·          Disposal of any waste unless quoted for

·          Plumping in taps. Herringbone will install your tap, however a plumber will be required to connect and plumb in.

·           Installation of any non-supplied unit, hardware or appliance unless quoted for.

·           Installation or venting of extractors through walls.

·           Due to new laws we cannot connect any electrical appliance (unless the company is contracted to arrange this with registered approved contractors) – this must be carried out by a qualified electrician.

·          Disposal of any refrigeration or any domestic appliance (we cannot dispose of fridges as under law disposal of such items is governed by strict environmental restrictions – please contact your local council).

·          Herringbone does not run ducting, this will need to be conducted by your own builders.
